DOG ATTACK MEDICAL BILLS

A mixed breed dog bit me in the arm as I was trying to protect my cockapoo in Lehigh County PA. Who pays for my medical bills?

  • If you have medical insurance, your health insurance company will initially pay for your medical expenses.
  • The PA dog bite injury lawyer will then seek to obtain medical bill reimbursement from the negligent dog owner’s insurance company.

How do I get reimbursed for my co-pays and deductibles after my Bucks County PA dog attack?

  • Most homeowners insurance contracts have a coverage entitled “med-pay”. This coverage is usually $1,000.00 or $5,000.00 and is used to compensate the victim for out-of-pocket medical expenses.
  • Your PA dog bite attorney will obtain the medical records and bills. He will then itemize your personal dog attack expenses for the insurance carrier.

Am I required to repay my insurance company for medical bills they paid due to my dog bite wounds?

  • Yes.  The health insurance companies typically have a “subrogation” and/or “reimbursement” clause that requires them to be repaid from the proceeds of your PA dog bite case settlement.
  • The Pennsylvania dog attack lawyer aggressively fights the health insurance company to get as much of a discount as he can obtain re: the subrogation lien.

PA DOG LAW

Who has the legal ability to file charges under the PA Dog Law?

  • A Pennsylvania County Dog Warden
  • A Pennsylvania State Trooper or a local police officer
  • Any person who has been attacked by a dog or whose dog has been killed or severely injured by another dog.
  • The Pennsylvania dog bite lawyer has attended many District Justice hearings on behalf of his PA dog attack victims.

A German Shepherd bit me in Carbon County, PA. How long does this vicious dog need to be quarantined?

FAILURE TO CONFINE

A roaming Akita attacked my daughter while she was jogging in Montgomery County, PA. Is this a violation of the PA Dog Law?

  • Yes. Section 459-305 is the “Failure to Confine” statute. The negligent dog owner is in violation of subsection (2) as the Akita was not firmly secured by means of a collar and chain.
  • The PA dog attack injury lawyer suggests you report the unprovoked dog attack to one of the two Montgomery County Dog Wardens.

My son was attacked by a neighbor’s Rottweiler while he was playing basketball in their Pike County, PA driveway. Was this dog properly confined?

  • No. The PA dog bite accident lawyer successfully argued these exact facts in a 2012 dog attack case in Monroe County. The Monroe County Court of Common Pleas affirmed a District Justice’s decision that the dog owner was guilty of failure to confine and she was fined for this violation of the PA Dog Law.

DANGEROUS DOG

A vicious pit bull attacked my child in Delaware County, PA causing severe injuries. Is there a dangerous dog law in Pennsylvania?

  • Yes. Section 459-502-A is the “Dangerous Dog” statute. The pit bull owner would be found guilty if:
    • it was an unprovoked attack and
    • the pit bull had a prior history of attacking or the district justice found the facts of this Delaware County PA case established a propensity to attack.

Can there be a dangerous dog finding after the Delaware County dog attack even if there is no proof of prior vicious propensities?

  • Yes. Section 459-502-A (2) (ii) permits the judge/district judge to find that violation based upon the facts of the attack itself without the need of proof of prior vicious propensities.
  • The lawyer for dog bites in Pennsylvania believes that many district justices prefer having evidence of a prior attack in order to convict under this section of the PA Dog Law.

PRIOR ATTACKS

My son was attacked by a boxer in Carbon County PA. If there is proof of a prior attack, will that help our PA dog bite case?

  • Yes. The Pennsylvania dog attack attorney will contact the Pennsylvania Department of Agriculture’s Harrisburg office. Attorney Newell will find out if there is any DOA record of a prior attack by this dog.
  • Proof of a previous attack will not only help the PA dog bite attorney with the liability portion of your PA dog attack claim, it may also help him establish a right to recover punitive damages.

My daughter was bit at a family party in York County PA. We know the Akita has attacked others in the past, what will the PA dog attack attorney do with this information?

  • The Pennsylvania dog bite lawyer will personally contact previous attack victims to get their testimony regarding the prior bite and their injuries. After the interview, he will draft an affidavit and forward it to the witness for their signature.
  • The PA dog attack injury attorney has been very successful in using evidence of prior vicious propensities to increase the value of the PA dog bite claim.

PIT BULLS

Is a “pit bull” a recognized breed of dog?

  • No. The breeds of dog that people generically call pit bulls are usually either an American pit bull terrier or an American Staffordshire terrier.

I was attacked by a pit bull in Monroe County PA. Will I receive a greater PA dog attack settlement amount because I was bit by a pit bull?

  • The defendant’s homeowners insurance company will negotiate with the PA dog bite lawyer and make every effort to settle the case before a PA dog attack lawsuit is filed.
  • While the key factor is the specific injury you suffered, it is the PA dog bite attorney’s experience that insurance companies place a high priority on settling Pennsylvania pit bull attack cases with him before a lawsuit needs to be filed.

If I go to a local shelter and adopt a pit bull, can my homeowner’s insurance company drop my coverage?

  • No. The PA Dog Law, Section 459-507A(d) states: “No liability policy issued pursuant to any act may prohibit coverage from any specific breed of dog.”

DOG ATTACK INFECTIONS

What are the signs that a dog bite wound has become infected?

  • hahnemannhospital.com identifies the following symptoms:
    • redness
    • swelling
    • drainage
    • pain
    • fever
  • The Pennsylvania dog bite lawyer encourages all PA dog bite victims to seek immediate medical care if any of these symptoms develop.
  • Some medical reports state that dogs and cats can pass on at least 30 different kinds of infections to human beings.

I was bit by a Dalmatian in Montgomery County PA. When I went to Mercy-Suburban Hospital, they gave me a tetanus shot. Is that normal?

  • Yes. Unless you have an up-to-date tetanus shot, they will give you a tetanus injection, especially if your skin has been broken by the dog’s teeth.
  • The Pennsylvania dog attack attorney advises all PA dog bite victims to promptly receive medical care.

DOG ATTACK FACIAL SCAR

According to Thomas Rohrer, M.D., a dermatologist and clinical professor at Boston University, you should:

  • Obtain professional medical care immediately after the dog attack
  • Keep the dog bite wound covered with a nonstick gauze bandage until it heals, unless your doctor advises to the contrary
  • Follow the surgeon’s recommendations re: which ointments to use and for how long
  • Avoid using hydrogen peroxide to cleanse the wound as it inhibits healing
  • Immediately notify your doctor if you see any sign of infection
  • The Pennsylvania dog bite attorney encourages all PA dog bite victims to seek immediate medical care if any of these symptoms develop.
  • Avoid sunlight, especially for the first 4-6 months post-bite

Which plastic surgeon should I take my daughter to see?

  • The Pennsylvania dog attack lawyer always recommends that your plastic surgeon should be “board certified” and very experienced in dealing with trauma caused facial wounds.
  • Many PA dog bite victims who are represented by the PA dog bite accident lawyer have been treated by a board certified plastic surgeon who has offices in the Lehigh Valley and Monroe County. Please contact him for more details.

SCAR REVISION SURGERY

What is scar revision surgery?

  • According to healthline.com, it is a surgery which cuts away scar tissue in order to remove or reduce the appearance of a scar.

Will I be put to sleep during the surgery?

  • Depending upon the complexity of the scar revision surgery, it can be done:
    • while you are awake (local anesthesia)
    • sleeping (sedated)
    • deep sleep (general anesthesia)

What does the plastic surgeon do to my scar?

  • The surgeon begins a series of small cuts (incisions) on both sides of the scar site. These create V-shaped skin flaps. The result is a thin and less noticeable scar because the wound closes after the surgery in a way that more closely follows your natural skin folds.

CONTACT W/ INSURANCE CO.

My son was attacked by a Rottweiler in Lehigh County PA. The dog owner’s insurance company wants me to give a recorded interview. Should I give them one?

  • Absolutely not! You have no legal obligation to do so and it would be contrary to the best interests of your son’s PA dog bite claim to give them the statement.
  • The PA dog attack accident lawyer never permits his PA dog attack clients to give a recorded statement to the dog owner’s insurance company.

I was bitten by a pit bull in Adams County PA. The defense adjuster wants me to sign a medical authorization. Should I cooperate?

  • No! The authorization they want you to sign undoubtedly gives them more access to your personal medical records than any court would order you to supply in this PA dog bite case.
  • The Pennsylvania dog bite injury attorney obtains a complete copy of his client’s medical records once all the medical care has ended.

The homeowner’s insurance company representative says I don’t need a PA dog bite lawyer for my Carbon County PA dog attack case. Why is he wrong?

  • His job on behalf of his employer and dog owner is to pay you as little as possible. He knows that without legal representation, your dog bite claim’s value is significantly reduced which benefits his company and the negligent dog owner.
  • Call the PA dog attack accident attorney today to schedule a free HOME consultation.

DERMABRASION SURGERY

What is dermabrasion surgery?

  • According to healthline.com, dermabrasion is a process to remove the top layers of the skin to make your skin more smooth.

Will I be awake during dermabrasion?

  • Yes, as most surgeons only use local anesthesia to numb the area he/she is working on.

How does the surgeon smooth out my skin?

  • The surgeon uses a special device to gently and carefully “sand” the surface of the skin down to normal, healthy and more smooth skin. An ointment is then placed on the treated skin to reduce scab formation.
  • Follow your surgeon’s advice on how long to avoid exposure to the sun after dermabrasion surgery has been performed.

DOG WARDENS

My daughter was mauled by a pit bull in Berks County. Who is the Berks County Dog Warden?

  • Edward Bunt. Call him immediately at 610-909-1173.

  • The PA dog bite lawyer urges you to speak to your neighbors to see if any of them are aware of prior attack by this pit bull.
