After Oral Argument by Attorney Newell and defense counsel, Judge Tully permitted a punitive damage claim to proceed to trial based upon “prior vicious propensities.”  This ruling took place even though there were no allegations in Attorney Newell’s Complaint of a prior physical attack on a human or animal.

Ground Breaking Legal Decision For PA Dog Bite Victims (Part 1)

On July 1, 2014, Judge William T. Tully issued a legal decision that greatly expands the rights of PA dog bite victims to fully hold negligent dog owners accountable. PA Police Officer Kills Attacking Dog

On June 27, 2014, a North Middleton Township Police Officer shot and killed a pit bull after it attacked him in Cumberland County, PA. According to the Sentinel News, the officer was assisting the Pennsylvania State Police in a search of a fleeing criminal.

As the officer was interviewing a potential witness, the pit bull charged him and tried to bite his left arm. The police officer shot the pit bull twice. The Cumberland County dog bite victim was treated for dog bite wounds at the Carlisle Regional Medical Center.

Another Dog Park “Dog Incident”

On June 9, 2014, PA dog bite lawyer, Thomas J. Newell, Esq. received a telephone call from a man who was involved in a dog attack/incident at a Lehigh Valley area dog park. The dog park has 2 separate enclosures. One has a sign “Small Dogs Only.” The other is a larger enclosure which is normally populated exclusively by larger dogs.

A woman decided to put her Jack Russell Terrier in with the larger dogs.  The terrier ran up to the larger dogs while barking. One of the dogs responded by biting the terrier.

The owner of the Jack Russell Terrier wants the owner of the large dog to reimburse her for the $2,000.00 in vet bills she has incurred. Unprovoked Montco Dog Attack
